 CommBank Bonus Points eShop terms and conditions

In these terms and conditions:

“We” or “us” means Commonwealth Bank of Australia, ABN 48 123 123 124, and where the context permits, includes Collinson.

“Collinson” means the operators of the Bonus Points eShop site on our behalf, Collinson Group Pty Ltd., ABN 24 121 054 724 and its UK parent, Collinson Latitude Ltd, Registered office: Cutlers Exchange, 123 Houndsditch London, EC3A 7BU UK. Registered no. 6708136. Registered in England and Wales.

The use of the CommBank Bonus Points eShop is subject to the following terms and conditions. By entering this website or registering as a member of the Bonus Points eShop you accept these terms and conditions.

1.    Membership

  1. Only one Bonus Points eShop account (Account) per person is eligible to earn Bonus Points.
  2. For customers with more than one CommBank Awards credit card, Bonus Points earned through the Bonus Points eShop will be awarded to the newest active card account based on account open date.
  3. In the event that a Bonus Points eShop Account is dormant for a period exceeding 12 months we may terminate that Account.
  4. The Bonus Points eShop is for the sole use of CommBank Awards cardholders and additional cardholders acting in their private capacity and is not for commercial purchases. If we suspect that an Account is being used other than for personal use (excluding permitted transactions made using a Business Awards card), we may terminate membership.
  5. If we in our sole discretion suspect fraudulent or suspicious activity we may without notice place an Account on hold, suspend transactions and/or terminate membership.

2.    Earning Bonus Points

  1. As a member of the CommBank Awards program, you will earn Bonus Points from retailers displayed on this eShop website, subject to the CommBank Awards Program Terms and Conditions and these eShop terms and conditions. The number of Bonus Points earned per retailer may be changed at any time.
  2. You must be signed in to the Bonus Points eShop and use the links to the participating retailers' sites to be eligible to earn Bonus Points. You cannot earn Bonus Points for purchases on a retailer’s site that you make prior to signing in the Bonus Points eShop.
  3. When you make a purchase on a retailer's site you enter into a contractual relationship with the retailer. The purchase of goods or services from participating retailers is subject to their terms and conditions of sale. If you have a complaint regarding the goods or services provided to you or regarding any delay or other delivery issue, you will need to take it up with the retailer. We make no warranty with regard to any products or services obtained by you from participating retailers and hereby expressly exclude all representations and warranties including those as to title, fitness for purpose, merchantability and/or satisfactory quality regarding goods and/or services obtained from participating retailers through the Bonus Points eShop.
  4. You become eligible for Bonus Points when the participating retailer approves the purchase i.e. the retailer is satisfied the transaction is complete and you’ve received the goods. Depending on the retailer's returns policy a purchase will normally be approved within 30 days.
  5. When you make a purchase in a foreign currency, the Bonus Points you earn for shopping via the Bonus Points eShop website will be calculated by Collinson based on the AUD equivalent of the purchase price, using an exchange rate set by Collinson from time to time. The amount charged in AUD to your credit card may be different as the exchange rate used for that is set by the relevant credit card scheme (or sometimes the retailer) and the Awards points you would usually earn if you pay using your CommBank Awards card are calculated on this amount in accordance with the CommBank Awards Program Terms and Conditions.
  6. If the transaction results in a refund or is cancelled, no Bonus Points will be earned.
  7. Where Bonus Points appear in your eShop transaction history or have been applied to your CommBank Awards account, but the transaction is later reversed by the participating retailer or cancelled by you, the Bonus Points will be reversed from your transaction history or account.
  8. Bonus Points have no equivalent cash value except as set out in these terms and conditions and the CommBank Awards Program Terms and Conditions.
  9. Bonus Points may only be earned on the net value excluding GST, all other taxes, surcharges and any delivery costs.
  10. Purchases made with retailer coupons or vouchers not sourced from this site may not be eligible for earning Bonus Points with these retailers.
  11. The purchase or redemption of gift cards are not eligible for earning Bonus Points.
  12. To claim missing points please visit the contact us section. Any claim for missing Bonus Points must be made to us within 90 days of your purchase.

3.    Tracking

  1. Transactions are electronically tracked and reported back by the participating retailer. Neither we nor Collinson are responsible if for any reason retailers are not correctly reporting sales to us or reporting back at all. We will, however, use reasonable efforts to ensure correct reporting by participating retailers. However we do not accept liability if retailers fail to do so.
  2. All participating retailers’ transactions are tracked through the use of cookies. You must ensure that cookies are enabled with your browser and ensure that any security software on your computer does not block cookies.

4.    Website changes and modifications to terms and conditions

  1. The content of the Bonus Points eShop website and these Terms and Conditions are subject to change at any time. Material changes are will be notified through the CommBank Awards website. When changes are made, we will make a new copy of these terms available on this website. We would advise you to make regular visits even if you are not intending to make a purchase.

5.    Copyright

  1. This Website is protected by copyright. The software is exclusive property of Collinson and we retain all rights, title and interest in and to the software throughout the world, including any modifications to and improvements to it.

6.    Third party websites

  1. We are not responsible for the content or availability of any of the third party websites that link from this Website.

7.    Use of the Bonus Points eShop website

  1. Neither we nor Collinson can be held responsible for any failure:
    1. of this Website; or
    2. in the system of communication between you and us, of whatever type or for whatever cause, which is beyond our reasonable control.
  2. We cannot be held responsible any unauthorised dealings with your Account of any kind.
  3. Reasonable efforts are made to ensure that material is virus-free before being placed on this Website. However, in the unlikely event of any loss, disruption or damage caused by a computer virus, we cannot be held responsible for any loss, disruption or damage to your data or computer system that may occur whilst using material derived from this Website.
